Avison Young’s Lease Consultancy team provide expert advice on all aspects of rent review negotiations and disputes. We liaise closely with our agency teams to ensure that clients are provided with the most up to date market evidence in relation to negotiations. Our Lease Consultancy team have an in depth knowledge of Landlord and Tenant case law and procedure. We provide pre-negotiation advice, a full appraisal of lease terms and any potential opportunities therein and a robust approach to negotiations.
Our team are also fully versed in presenting Expert Witness reports for Independent Expert determination and Arbitration in relation to rent review disputes. Close liaison with the agency and Investment teams is critical in this regard given the requirement for Expert Witness’s to provide a true and honest opinion of market rental value.

We liaise closely with our Occupational and Investment agency teams as well as our Asset Managers to ensure our clients are provided with the best advice in relation to renewal negotiations.
The Lease Consultancy team have an in depth knowledge of landlord and tenant law and its application to lease renewals. We work closely with our Building Consultancy and Agency team to ensure that the wider aspects of lease expiry negotiations are taken into consideration including potential dilapidations liability and location costs.
Our Lease Consultancy team are experienced in providing Expert Witness reports for both court hearings and PACT dispute resolution in relation to lease renewal matters. Our market position ensures that our Expert Witness reports include the most up to date and relevant rental evidence which can prove persuasive in litigation situations.

The Lease Consultancy team at Avison Young provide advice to both owners and occupiers in relation to existing lease structures. We appraised current lease terms and advice on any potential opportunities for restructuring or re-negotiation of terms in order to improve asset values and reduce occupational costs. Our Lease Consultancy team work closely with the Asset Management, Investment and Occupational Agency teams to provide first class advice in this respect with up to date market knowledge being critical in relation to negotiation’s on behalf of clients.
Our in depth knowledge of landlord and tenant Case law and legislation allows us to identify opportunities at an early date in order that owners or occupiers are best advised in the medium to long term.
Our professional services team provide Valuation advice in relation to a variety of matters including company accounting, dilapidations disputes, secured lending and asset / pension fund matters.
A number of the Avison Young team are RICS Registered Valuers who are able to provide accurate valuations for both owners and occupiers in relation to their property assets. We work closely with out occupational and investment agency teams to ensure that market valuations are accurate and up to date and provide the best possible indication of asset values. In addition, we provide advice in relation to Compulsory Purchase and Acquisition on behalf of both claimants and acquiring authorities. Our team are well versed in the legislation and case law relating to CPO matters and often work as part of multi-disciplinary groups. Again, close liaison with the agency teams allows us to provide accurate advice for both budgeting and negotiation purposes.
Avison Young Partner, Graham Aitkenhead BSc MRICS ACIArb is a member of the Royal Institute of Chartered Surveyors Dispute Resolution panel and takes appointments as both Arbitrator and Independent Expert in relation to rent review and lease renewal dispute across the North West of England. He focuses on the Office, Industrial and Retail sectors. Graham is also an Associate member of the Chartered Institute of Arbitrators.

Description: WHR advised Bloor Homes North West Limited in relation to their 2015 rent review for office accommodation in Congelton. We successfully negotiated a substantial reduction from the landlords original quoting rent and secure a lease extension protecting our client’s occupation of the property for the medium term.

Description: WHR advised The Fragrance Shop Limited in relation to their rent review in the Arndale, Manchester. Following detailed negotiations the matter progressed to rent review Arbitration and WHR provided Expert Witness reports on behalf of the tenant securing a substantial reduction from the landlords proposed rental increase.

Description: WHR advised Mayer Investments Limited in relation to Peter House, Oxford Street, Manchester. We successfully secured increases on review in relation to retail and leisure premises for the ground floor of a prime office / retail investment and helping to enhance the asset value.

Project: Lease Renewal
Description: advising the landlord in relation to lease renewal of 300,000 sq. ft. industrial accommodation in North West Manchester. Working closely with our Industrial Agency Team we agreed new terms with the tenant and securing the income. This enhanced the asset value of the freehold interest allowing for an onward sale to take place.

Description: providing advice and Expert Witness reports in relation to a contested lease renewal for 28,000 sq. ft. of office accommodation in Sale, Cheshire. Assisting in securing the ongoing occupation of the premises by the tenant thus enhance the asset value on behalf of the landlord.
Client: Mettler Toledo Safeline Limited
Project: Lease Restructuring Description: negotiating an early renewal on behalf of the tenant for 10,000 sq. ft. of industrial accommodation in Salford. Securing the clients long term occupation of the site and obtaining incentives from the landlord for the company’s ongoing occupation. Restructuring the lease in order that the client long term occupation of the site is protected in conjunction with their additional leasehold interests on the site.
